PETRA Terms of Use
Effective date: 21 October 2026 · Version: 1.0 · Version française
These Terms of Use ("Terms") apply to the PETRA iPhone app ("PETRA", "the app"), published by Winmore Huswiswi Zimmermann (known as Wayne Zimmermann), an individual developer based in the United Kingdom ("I", "me"). Please read them, especially section 3 (Health and safety).
1. Your licence: Apple's Standard EULA
PETRA is licensed to you, not sold, under Apple's Licensed Application End User License Agreement (the "Standard EULA"): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms add to the Standard EULA. If they conflict, the Standard EULA applies to the licence and these Terms apply to everything else.
By downloading or using PETRA you agree to the Standard EULA and these Terms. If you don't agree, please don't use the app.
2. Who can use PETRA
PETRA is for adults aged 18 or over. You need to complete the in-app safety check honestly before you start.
3. Health and safety (please read)
PETRA is a fitness and wellness coaching tool. It is not a medical device and does not give medical advice, diagnosis or treatment. Its plans and suggestions come from general exercise guidance and fixed rules. They are not tailored by a doctor, physiotherapist or other health professional, and they can't take the place of one.
- Check with a doctor before you start if you have, or think you may have, a heart condition, high blood pressure, chest pain, dizziness or fainting, diabetes, joint or back problems, a recent injury or operation, or if you are pregnant or have recently given birth, or are unsure whether exercise is safe for you.
- Stop straight away if you feel pain, chest tightness, unusual shortness of breath, dizziness, faintness or nausea. Use Stop & Report discomfort in the app, and seek medical advice. In an emergency call 999 (UK), 112 (EU) or 15 (SAMU, France).
- Exercise within your limits. You decide whether to do each exercise and how hard to work. Warm up, stay hydrated, and use a safe space with stable footing and suitable shoes and equipment.
- Outdoors, stay aware of traffic, terrain, weather and your surroundings. Don't look at your phone while moving near roads. Distance, pace and time from GPS are estimates and can be inaccurate.
- Exercise videos, written cues and voice cues show general technique. They can't see you or correct your form.
- A self-reported "doctor has cleared me" answer is your own statement. PETRA can't verify it.
You take part in physical activity at your own risk, subject to section 8, which keeps the protections the law gives you.
4. What PETRA offers
PETRA is currently free, with no in-app purchases or subscriptions. Features may change, improve or be withdrawn over time. If I ever introduce paid features, the price and terms will be shown clearly before you pay, and you'll never be charged without agreeing.
5. Your data
PETRA keeps your data on your iPhone. My Privacy Policy explains how your information is handled. You're responsible for your device, its passcode and your backups. If you delete the app or use Delete all my data, your PETRA data can't be recovered, because I don't hold a copy.
6. Third-party services
Exercise demos play from YouTube (Google) only after you agree. YouTube's Terms of Service and Google's Privacy Policy apply to those videos. "Near me" results come from Apple Maps. I'm not responsible for third-party services, content or the businesses listed in search results. Listing a trainer or studio is not a recommendation.
7. Acceptable use and content
Please use PETRA only for personal, non-commercial purposes and don't copy, modify, reverse-engineer (except as the law allows), resell or misuse it. The PETRA app, text, design, workout programmes and branding belong to me or my licensors (including GYM Blazers) and are protected by intellectual property laws.
8. Liability
- Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited or excluded by law. Nothing affects your statutory rights as a consumer.
- PETRA is provided free of charge, "as is" and "as available". To the extent the law allows, I don't promise that it will be uninterrupted, error-free or suitable for a particular goal, or that you'll get particular fitness results.
- To the extent the law allows, I'm not responsible for losses that weren't foreseeable, for losses caused by your failure to follow the health and safety guidance above, or for business losses. PETRA is for personal use.
9. Apple
These Terms are between you and me, not Apple. Apple has no obligation to provide maintenance or support for PETRA. Apple isn't responsible for addressing any claims relating to PETRA, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
10. Ending use
You can stop using PETRA at any time by deleting it. I may stop offering PETRA or update it. If I withdraw it, the app may stop receiving updates.
11. Changes to these Terms
I may update these Terms, for example when features or the law change. I'll update the date above and, for important changes, tell you in the app. If you keep using PETRA after changes take effect, the new Terms apply.
12. Law and disputes
These Terms are governed by the laws of England and Wales. If you live in Scotland, Northern Ireland or the European Union, you also keep the mandatory consumer protections of where you live and may bring proceedings in your local courts. Please contact me first so we can try to sort things out. If you live in the EU you can also use your national consumer mediation service.
